《邯郸市人民政府制定规章和拟定法规草案规定修正案》已经2018年8月13日邯郸市人民政府第23次常务会议审议通过,现予公布,自公布之日起施行。

The Amendment to the Provisions of Handan Municipal People's Government on the Procedures for Making Rules and Drafting Regulations, which was adopted on the 23rd executive meeting of Handan Municipal People’s Government on August 13, 2018, is hereby promulgated and shall come into force as of the date of promulgation.

邯郸市人民政府制定规章和拟定法规草案规定修正案 

Amendment to the Provisions of Handan Municipal People's Government on the Procedures for Making Rules and Drafting Regulations 

  

一、删除第二条第二款、第三款。 

1. The second and third paragraphs of Article 2 are deleted. 

二、第三条第(一)项修改为:“法律、法规规定由设区的市政府作出规定的事项。” 

2. The item (i) of Article 3 is amended to read: “Matters subject to the government’s rules of the city divided into districts under a national law and regulation .” 

第(三)项修改为:“为执行法律、行政法规、地方性法规和省政府规章的规定,需要制定规章的事项。” 

The item (iii) is amended to read: “Matters for which the enactment of a local rule is required in order to implement a national law, national administrative regulation, local regulation and/or Provincial regulation.” 

三、第五条第(二)项修改为:“精简、统一、效能的原则。相同或相近的职能应当规定由一个行政机关承担,简化行政管理手续,促进政府职能向宏观调控、市场监管、社会管理、公共服务、环境保护等方面转变。” 

3.  The item (ii) of Article 5 is amended to read: “The principle of simplification, unity and efficiency or efficacy. The same or similar functions shall be performed by one administrative organization, so as to simplify administrative procedures and promote the transformation of government functions into macro-control, market supervision, social management, public services and environmental protection.” 

第(三)项修改为:“职权与责任相统一原则。在赋予有关行政机关必要的职权的同时,应当规定其行使职权的条件、程序和应承担的责任。切实保障公民、法人和其他组织的合法权益,没有法律、行政法规、地方性法规的依据,规章不得设定减损公民、法人和其他组织权利或者增加其义务的规范。” 

The item (iii) thereof is amended to read: “The principle of unity of authority and responsibility. While conferring the necessary powers to the relevant administrative organization, it shall stipulate the conditions, procedures and responsibilities for exercising the power. The lawful rights and interests of physical and moral persons and other organizations shall be protected and guaranteed effectively. Without the basis of national laws, national administrative regulations and/or local regulations (decree), the rules shall not set norms that derogate from the rights or increase obligations of citizens, legal persons and other organizations.” 

四、第六条第(七)项修改为:“研究上位法立法动态、本市立法情况,清理本市规章。” 

4.  The item (vii) of Article 6 is amended to read: “To study the legislation trends of higher norms, the legislative situation of the municipality and to clean up the rules.” 

五、第八条修改为:“市财政部门应当按年度拨付立法经费,用于制定规章和拟定法规草案的起草、调研、论证、发布、翻译和汇编等项工作”。 

5. Article 8 is amended to read: “The Municipal Finance Department shall allocate legislative funds on an annual basis for the drafting, research, feasibility study, publication, translation and compilation of the rules and draft regulations.” 

六、第九条修改为:“市政府立法机构应当于每年10月前启动下一年度立法工作计划项目征集工作。征集立法项目可以通过下列途径进行: 

6. Article 9 is amended to read: “The Municipal Legislative Affairs Office shall start the solicitation of the next year’s legislative work plan before October each year. Solicitation of legislative items may be conducted by the following: 

“(一)向市政府部门和县(市、区)人民政府征集立法建议项目; 

“(i) Soliciting legislative proposals from Municipal Government departments and the people's governments at county level (municipality and district);  

“(二)向人大代表、政协委员,以及民主党派、社会团体、行业协会、企业事业等单位征集立法建议项目; 

“(ii) Soliciting legislative proposals from deputies to the people's congress, members of the Chinese People's Political Consultative Conference ( hereinafter referred to as the CPPCC), as well as institutions such as democratic parties, social organizations, trade associations, enterprises and so on; 

“(三)向社会发布通告征集立法建议项目。 

“(iii) Issuing circulars to the public to solicit legislative proposals.” 

七、第十一条第一款修改为:“市政府立法机构对制定规章和拟定法规草案的建议进行汇总并作综合分析、评估论证后,编制市政府制定规章和拟定法规草案的年度计划草案报市政府常务会议审定。年度立法工作计划草案提交市政府常务会议审定前,应当按照规定向有关机关履行报告程序。” 

7. The first paragraph of Article 11 is amended to read: “The Municipal Legislative Affairs Office shall, after summarizing, and making comprehensive analysis, evaluation and feasibility study of the proposals for the formulation of rules and draft regulations, prepare the annual legislative work plan draft for the formulation of rules and draft regulations and submit it to the executive meeting of the Municipal Government for review and approval. Before the draft of annual legislative work plan is submitted to the executive meeting of the Municipal Government for review and approval, it shall report to the relevant authorities in accordance with the relevant provisions.” 

八、第十二条第二款修改为:“市政府可以确定一个部门或者几个部门具体承担起草工作,也可以确定由市政府立法机构起草或组织起草,起草专业性较强的规章,可以吸收相关领域的专家参与起草工作,或者委托有关专家、教学科研单位、社会组织起草。” 

8. The second paragraph of Article 12 is amended to read: “The Municipal Government may assign one or several departments to be responsible for the drafting, or assign the Municipal Legislative Affairs Office to draft or organize the drafting. If the draft rules are highly professional, the experts in related fields shall be invited into the drafting work, or the relevant experts, education & research institutions and social organizations can be entrusted to draft.” 

九、第十三条第二款修改为:“市政府立法机构应当对市政府制定规章和拟定法规草案年度计划项目的起草情况进行检查、督促、协调和指导。年度计划执行中需要进行个别调整的,由市政府立法机构报请市政府确定,拟增加的规章项目应当进行补充论证”。 

9. The second paragraph of Article 13 is amended to read: “The Municipal Legislative Affairs Office shall inspect, supervise, coordinate and guide the drafting of the Municipal Government's rules and the annual legislative work plans of the draft regulations. If individual adjustments are needed in the implementation of the annual legislative work plan, the Municipal Legislative Affairs Office shall report to the Municipal Government for confirmation and approval. The proposed supplementary regulations and items shall be further described and demonstrated.”  

十、增加一条作为第十四条:“起草规章和法规,除依法需要保密的外,起草单位报请市政府同意,将规章草案或法规送审稿及其说明等,向社会公布,公开征求意见,征求意见的期限一般不少于30日。” 

10. One new article is inserted as Article 14 to read: “For the draft of rules and regulations, except those that need to be kept confidential according to law, the drafting body shall ask for Municipal Government’s approval on publishing the submitted version of the draft rules and the draft regulations, together with their commentaries to the public for consultation. The time duration for soliciting opinions shall generally not be less than 30 days.” 

十一、第十七条作为第十五条,修改为:“起草的规章或法规涉及重大利益调整或者存在重大意见分歧,对公民、法人或者其他组织的权利义务有较大影响,人民群众普遍关注,需要进行听证的,起草单位应当举行听证会听取意见。听证会依照下列程序组织: 

11. Article 17 is changed to Article 15 and amended to read: “When the draft rules and/or regulations involve major interest adjustments, or have major differences of opinions, or have a great impact on the rights & obligations of citizens, legal persons and/or other organizations to obtain great attention from people, and the hearing becomes necessary, the drafting body shall hold a hearing to solicit for opinions after approval by the Municipal Government. The hearing shall be organized in accordance with the following procedures:  

“(一)听证会公开举行,起草单位应当在举行听证会的30日前通过市政府网站,或者部门网站及其他新闻媒体公布听证会的时间、地点和内容,以及申请作为听证陈述人的条件、申请的方式和截止时间等; 

“(i) The hearing shall be held in public. The drafting body shall announce the time, place, content of the hearing through the website of the Municipal Government or the department website and other news media 30 days before the hearing, conditions for, the method and deadline of applying as a hearing representor, etc. 

“(二)起草单位应当根据代表广泛性、利益相关性等原则,从申请人中选定10至20名陈述人,必要时,可以直接指定利益相关方代表、有利害关系的部门和个人或者邀请有关人大代表、政协委员及民主党派、无党派人士和专家、学者作为陈述人;  

“(ii) The drafting body shall select 10 to 20 presenters from the applicants based on the principles of universality of representation, interest relevance etc. Where necessary, representatives of parties, departments and individuals with interests may be directly designated, and representatives of the people's congresses, members of the CPPCC committees and representatives of democratic parties, personages without party affiliation and experts as well as scholars may be invited as representors.  

“(三)起草单位应当确定一名听证主持人,确定不少于2名听证人,听证人由承办人及熟悉征求意见稿的人员担任,负责在听证会上对听证事项进行说明、解释; 

(iii) The drafting body shall designate one hearing moderator/presider and not less than two hearing attendees (participants) to attend the public hearing. The attendees shall be the undertakers who are familiar with the exposure draft, and the attendees are responsible for the commentaries and explanation of issues discussed in the public hearing. 

“(四)参加听证会的有关机关、组织和公民对起草的规章,有权提问和发表意见; 

“(iv) The relevant authorities, physical or moral or representatives of any other recognized organization participating in the hearings shall have the right to ask questions and express their opinions on the draft rules;  

“(五)听证会应当制作笔录,如实记录发言人的主要观点和理由; 

“(v) A written record shall be prepared for the hearing to truthfully record the speaker's major views and reasons; 

“(六)起草单位应当认真研究听证会反映的各种意见,起草的规章在报送审查时,应当说明对听证会意见的处理情况及其理由。 

“(vi) The drafting body shall carefully study the various opinions in the hearing. The draft rules, upon submission for review, shall state the handling of proposals at the hearing and the corresponding reasons.  

“(七)听证会结束后5个工作日内拟定听证报告,详细汇总各方面的意见。 

“(vii)  The report of the hearing shall contain a detailed summary of the opinions of all the parties present at the hearing. The g report shall be finished within 5 working days after the hearing.”  

十二、第十四条作为第十六条,第二款修改为:“起草单位报送规章和法规草案送审稿时,应当同时提交起草说明和所依据的有关资料。起草说明应包括起草的经过、制定规章或法规的必要性、规章或法规草案主要措施、有关方面的意见及其协调处理情况等内容。有关资料主要包括所规范领域的实际情况和相关数据、实践中存在的主要问题、汇总的意见、听证会笔录、调研报告、市内外有关立法资料等”。 

12.  Article 14 is changed to Article 16 and the second paragraph thereof is amended to read: “The drafting body shall simultaneously submit for review the draft rules and regulations, commentaries and any relevant materials on which the draft is based. The drafting explanations shall include the process of drafting, the necessity of formulating rules or regulations, the main measures included, the opinions of the parties concerned and handling of their opinions. The relevant materials mainly include the actual situation and relevant data in the normative field, the main problems or issues in practice, the summary of opinions, the written record of the hearing, the investigation report, and the relevant legislative materials within and outside Handan city.” 

十三、第十五条作为第十七条,第(三)项中的“设定”改为“涉及”; 

13. Article 15 is changed to Article 17, and the expression “established” in the first paragraph thereof is replaced by the expression “involved”. 

增加一项作为第(四)项:“是否有利于促进公平竞争和经济社会发展;” 

One new item is inserted as the item (iv) to read: “Whether it is conducive to promote fair competition and socioeconomic development.” 

增加一项作为第(五)项:“是否进行社会稳定风险评估。” 

One new item is inserted as the item (v) to read: “Whether to carry out risk assessment of social safety and stability.” 

十四、第十八条作为第十九条,增加一款作为第一款:“规章送审稿有下列情形之一的,市政府立法机构可以中止审查、缓办或退回起草单位,并要求起草单位重新起草或者提出合理的解决方案: 

14.  Article 18 is changed to Article 19, and a new paragraph is inserted as The first paragraph to read: “If the submitted version of the draft rules for review under any of the following circumstances, the Municipal Legislative Affairs Office may suspend or postpone the review, or return it to the drafting body, and request the drafting body to re-draft or propose reasonable solutions: 

“(一)制定规章的基本条件尚不成熟或者发生重大变化的; 

(i) Where the basic conditions for the formulation of rules are still immature or major changes have taken place; 

“(二)有关机构或者部门对规章送审稿规定的主要制度存在较大争议,起草单位未与有关机构或者部门充分协商的; 

“(ii) Where the relevant institutions or departments have a big dispute over the main system stipulated in the provisions of submitted version of the draft rules, but the drafting body has not fully consulted the relevant institutions or departments; 

“(三)未按照本规定有关规定公开征求意见的; 

“(iii) Failure to solicit public opinions in accordance with the relevant rules hereof; 

“(四)送审稿主要内容严重违法的。 

“(iv). Where the main content of the submitted version of the draft rules is seriously illegal or contrary to the laws in force 

第二款修改为:“中止审查、缓办或退回原起草单位应附书面意见,说明存在的主要问题。原起草单位应当进行修改或按本规定要求重新组织起草,并及时报送市政府立法机构。” 

The second paragraph is amended to read: “Any suspension of review, postponement or return to the drafting body during the process shall be accompanied by a written opinion indicating the main problems. The original drafting body shall revise or reorganize the drafting according to the requirements of these Provisions and submit the draft to the Municipal Legislative Affairs Office within a reasonable time limit.” 

十五、第二十条作为第二十一条,第一款修改为:“规章和法规草案内容对全市发展有重大影响,或者涉及公民、法人和其他组织的重大权益的,经市政府同意,市政府立法机构应在市政府审议前将草案全文在《邯郸日报》、市政府门户网站或市政府立法机构网站上全文公布,公开征求社会各界的意见。公布征求意见的期限一般不少于30日。” 

15.  Article 20 is changed to Article 21, and the first paragraph is amended to read: “The Municipal Legislative Affairs Office shall publish the full version of the draft for soliciting the opinions of the public on the Handan Daily, the website of Municipal Government and/or the website of the Municipal Legislative Affairs Office before the deliberation of the Municipal Government when the drafted rules and/or regulations have significant impact on the development of the whole Municipality, or involve the important rights & interests of citizens, legal persons and other organizations, upon the approval of the Municipal Government. The time limit for public consultation shall not be less than 30 days.” 

十六、第二十一条作为第二十二条,修改为:“有关部门和单位对规章和法规草案内容有不同意见的,市政府立法机构应当进行协调,力求达成一致意见。对有较大争议的重要立法事项,市政府立法机构可以委托有关专家、教学科研单位、社会组织进行评估。经协调仍不能达成一致意见的,应当将主要问题、有关机构或者部门的意见和立法机构的意见及时报市政府协调,或者报市政府决定。” 

16. Article 21 is changed to Article 22 and amended to read: “If relevant departments and authorities have a major difference of opinion on the content of the rules and draft regulations, the Municipal Legislative Affairs Office shall coordinate and strive to reach a consensus. If there is a major difference of opinions on major issues, the Municipal Legislative Affairs Office may entrust to relevant experts, education & research institutions and social organizations to evaluate significant legislative matters in dispute. If no consensus can be reached after coordination and consultation, the major issues, opinions of relevant agencies, departments and the Municipal Legislative Affairs Office shall be reported to the Municipal Government for timely coordination or further decision.” 

十七、增加一条作为第二十三条:“规章或法规送审稿涉及重大利益调整的,市政府立法机构应当进行论证咨询,广泛听取有关方面的意见。论证咨询可以采取座谈会、论证会、听证会、委托研究等多种形式。 

17. One new article is inserted as Article 23 to read: “ When the submitted version of the draft rules and draft regulations involves major adjustments of interests, the Municipal Legislative Affairs Office shall conduct the feasibility study and consultation, and listen to the opinions of relevant parties extensively. Demonstration and consultation may take place in various forms, such as symposium, feasibility study meeting, hearing, and commissioned research.” 

“规章或法规送审稿涉及重大利益调整或者存在重大意见分歧,对公民、法人或者其他组织的权利义务有较大影响,人民群众普遍关注,起草单位在起草过程中未举行听证会的,市政府立法机构经市政府批准,可以举行听证会。举行听证会的,应当依照本规定第十五条规定的程序组织。 

“The Municipal Legislative Affairs Office may hold a hearing upon the approval of the Municipal Government when the drafting body fails to hold a hearing during the drafting process when the submitted version of the draft rules and draft regulations involve major adjustment of interests or major disputes, have a significant impact on rights & interests of physical and corporate persons and other organizations, and obtain great attention from the people. When a hearing is held, the hearing shall be organized in accordance with the procedures stipulated in article 15 hereof.” 

十八、增加一条作为第二十四条:“重要的政府规章和地方性法规项目,应当进行立法协商。涉及职工、妇女儿童、残疾人等不同社会群体利益的,应当征求市总工会、市妇联、市残联等社会团体的意见。充分发挥政协委员、民主党派、工商联、无党派人士、人民团体、社会组织的作用。 

18.  One new article is inserted as Article 24 to read: “The major and significant government rules and local regulations shall be subject to legislative consultation. If the interests of different social groups, such as workers, women and children, and disabled persons are involved, it shall be consulted by social federations like the municipal federation of trade unions, the municipal women's federation, and the municipal federation of disabled persons. We shall give full play to the role of CPPCC members, democratic parties, federation of industry and commerce, personages without party affiliation, people's organizations and social organizations. 

“立法协商可以采用书面征求意见、座谈会、委托论证、联合调研等方式进行。” 

The legislative consultation may be conducted by means of soliciting opinions in writing, seminars, feasibility study-commissioned and joint research.” 

十九、第二十二条作为第二十五条,删除第三款。 

19. Article 22 is changed to Article 25, and the third paragraph hereof is deleted. 

二十、第二十三条作为第二十六条,修改为:“规章草案或法规草案送审稿由市政府常务会议或全体会议讨论决定。市政府办公厅应当提前将规章草案或法规草案送审稿及审查报告报送市长及市政府其他各位领导。规章草案需要向有关机关报告的,应当在审议前按照规定履行报告程序。” 

20. Article 23 is changed to Article 26 and amended to read: “The submitted version of the draft rules and the draft regulations for review shall be discussed and determined by the executive meeting or plenary meeting of the Municipal Government. The General Office of the Municipal Government shall submit the submitted version of the draft rules and/or the regulations for review, together with its review report, to the mayor and other leaders of the Municipal Government in advance. Where it is necessary to report the draft rules to the relevant authorities, the reporting procedures shall be performed in accordance with the provisions before the meeting for deliberation.” 

二十一、第二十六条作为第二十九条,删除第三款。 

21. Article 26 is changed to Article 29, and the third paragraph hereof is deleted. 

二十二、第二十七条作为第三十条,第一款修改为:“规章公布后,《邯郸市人民政府公报》和《邯郸日报》应当及时全文登载,《邯郸晚报》、邯郸广播电视台应及时发布消息。重要的规章,《邯郸日报》、邯郸广播电视台相关栏目应当配合刊发有关评论和文章;必要时,市政府立法机构可以组织召开新闻发布会或在《邯郸日报》、邯郸广播电视台相关栏目上就有关问题进行解答。” 

22. Article 27 is changed to Article 30, and The first paragraph is amended to read:  “After the publication of the rules, Handan People's Government Bulletin and Handan Daily shall print the rules in full within a reasonable time frame; Handan Evening Newspaper and Handan Radio & Television Station shall release information timely. If the rules are important, Handan Daily and Handan Radio & Television Station shall publish the related commentary and articles in relevant columns. If necessary, the Municipal Legislative Affairs Office can organize a press conference, answer questions directly on relevant columns of Handan Daily and Handan Radio & Television Station.” 

二十三、增加一条作为第三十一条:“规章公布后,由市政府立法机构按照《法规规章备案条例》的规定,向国务院、省人大常委会、省政府、市人大常委会备案。 

23.  One new article is inserted as Article 31 to read: “After the promulgation of the rules, the Municipal Legislative Affairs Office shall, in accordance with provisions stipulated on the Ordinance on the Archivist Filing of Regulations and Rules, submit to the State Council, the Standing Committee of Hebei Provincial People's Congress, Hebei Provincial Government and the Standing Committee of Handan Municipal People's Congress for filing. 

“规章公布后,市政府立法机构应当在三个月内,组织规章英文翻译,并将中英文对照版在市政府门户网站、市政府立法机构门户网站公布。 

“After the promulgation of the regulations, the Municipal Legislative Affairs Office shall organize and ensure the English translation of the regulations and publish the bilingual version on the portal website of the Municipal Government and the portal website of the Municipal Legislative Affairs Office within three (3) months’ time interval.”  

二十四、增加一条作为第三十二条:“国家机关、社会团体、企业事业组织、公民认为市政府规章同法律、行政法规相抵触或者违反其他上位法的规定的,可以向国务院、省政府或市政府书面提出审查建议。 

24.  One new article is inserted as Article 32 to read: “Where any state organ or social group, enterprise or non-enterprise institution or citizen, deems that the rules contravene a national law and or a national administrative regulation, or in violation of the provisions of other higher norms, it may make a written proposal to the State Council, Hebei Provincial Government or Handan Municipal Government for review. 

“向市政府提出的书面审查建议,可以直接送市政府立法机构,市政府立法机构应当组织审查论证,并在60日内向建议提出人书面反馈。 

“The written proposal for further examination submitted to the Municipal Government may be directly sent to the Municipal Legislative Affairs Office. The Municipal Legislative Affairs Office shall organize the review and feasibility study on it, and give written feedback to the person that submitted the proposal within 60 days.”  

二十五、增加一条作为第三十三条:“有下列情形之一的,市政府立法机构应当组织进行规章清理: 

25.  One new article is inserted as Article 33 to read:  “In any of the following circumstances, the Municipal Legislative Affairs Office shall organize the clean-up of rules: 

“(一)上级机关或者法律、行政法规规定要求清理的; 

“(i) Where a higher authority or a law or administrative regulation requires such cleaning up; 

“(二)上位法发生制定、修改或者废止等情形涉及多件规章,需要进行清理的; 

“(ii) Where the formulation, amendment or abolition of higher norms involves a number of rules that need to be cleaned up; 

“(三)根据经济社会发展要求,有较多规章存在明显不适应情形,需要进行清理的; 

“(iii) Where there are many rules that obviously do not adapt to the situation and need to be cleaned up in accordance with the requirements of economic and social development;  

“(四)其他原因需要进行清理的。 

“ (iv) Where the rules need to be cleaned up for other reasons.” 

二十六、增加一条作为第三十四条:“市政府授权市政府立法机构组织立法后评估,并把评估结果作为修改、废止有关规章的重要参考。 

26. One new article is inserted as Article 34 to read: “The Municipal Government shall authorize the Municipal Legislative Affairs Office to organize the post-legislation evaluation, and shall take the evaluation results as an important reference for revising and abolishing relevant regulations. 

“规章有下列情形之一的,市政府立法机构应当组织开展立法后评估: 

“In the case of any of the following situations, the Municipal Legislative Affairs Office shall organize the post-legislative evaluation for the regulations:  

“(一)施行满3年的; 

“(i) Where it is three years since regulations implementation  

“(二)拟以规章为基础提出地方性法规案的; 

“(ii) Where the draft regulations are proposed on the basis of the rules. 

“(三)需要进行全面修订或者较大幅度修改的; 

“(iii) Where it is necessary to make a comprehensive or substantial revision  

“(四)公民、法人和其他组织有较多意见的; 

“(iv) Where physical and moral persons and other organizations have great dispute over the regulations.  

“(五)市政府立法机构认为需要评估的。 

“(v) Where the Municipal Legislative Affairs Office deems regulations necessary to be assessed. 

“规章立法后评估可以委托有关专家、高等院校、科研机构、专业智库、律师事务所等实施,也可以由市政府立法机构、实施机关组织实施。” 

“The post-legislative evaluation of regulations may be conducted by entrusting to relevant experts, universities, scientific research institutions, professional think tanks, law firms, etc., or be organized and implemented by the Municipal Legislative Affairs Office and the implementing organizations.” 

二十七、删除第二十八条。 

27.  Article 28 is deleted. 

二十八、第三十条作为第三十六条,第二款中的“可作为执法、守法的依据”改为“作为执法、守法的依据”。 

28. Article 30 is changed to Article 36, and the expression “which may be used as the evidence for law enforcement and compliance” in the second paragraph thereof is replaced by the expression “which is used as the evidence for law enforcement and compliance. 

二十九、增加一条作为第三十七条:“规章明确规定有关单位对专门事项制定配套的具体规定的,有关单位应当自施行之日起3个月内作出规定。规章对配套具体规定制定明确特定期限的,从其规定。 

29.  One new article is inserted as Article 37 to read:“Where the relevant regulations clearly stipulate that the relevant organizations shall formulate detailed ancillary provisions for special matters, the relevant organizations shall make provisions within three (3) months from the date of implementation. Where the regulations specify a specific time limit for detailed ancillary provisions, the provisions shall apply. 

“有关单位未能在期限内制定配套的具体规定的,应当书面向市政府报告。” 

“If the relevant organization fails to formulate specific detailed ancillary regulations within the time limit, they shall report to the Municipal Government in written form within a reasonable time frame.” 

三十、增加一条作为第三十八条:“本办法第三条、第四条所涉事项,仅限于城乡建设与管理、环境保护、历史文化保护等方面的事项。” 

30. One new article is inserted as Article 38 to read: “The matters covered by articles 3 and 4 of these Provisions are limited to the matters relating to the urban and rural development and administration, the environmental protection and the historical culture protection. 

三十一、文件中的“市人民政府法制机构”“市政府法制机构”均改为“市政府立法机构”。 

31. The expressions “Legislative Affairs Office of the Municipal People’s Government” and “Legislative Affairs Office of the Municipal Government” in this document are replaced by the “Municipal Legislative Affairs Office.”

第一条 为使制定邯郸市政府规章(以下简称规章)和拟定邯郸市法规草案(以下简称法规草案)的工作科学化、规范化,提高制定规章和拟定法规草案工作的效率,保证规章和法规草案的质量,根据《中华人民共和国立法法》、国务院《规章制定程序条例》等有关法律、法规,制定本规定。 

Article 1.  The Provisions are formulated in accordance with the Law on Legislation of the People's Republic of China, the Regulation on the Procedures for the Formulation of Administrative Regulations of the State Council, and other relevant laws and regulations with a view to making the work of enacting local rules of Handan Municipal Government (hereinafter referred to as the rules) and drafting local regulations of Handan Municipality (hereinafter referred to as the draft regulations/decree) scientific and standardized, improving the efficiency of enacting rules and drafting regulations as well as ensuring the quality of the rules and draft regulations. 

第二条 制定规章和市政府拟定法规草案,适用本规定。 

Article 2. The Provisions are applicable to the making of rules and drafting regulations. 

第三条 下列事项,由市政府制定规章: 

Article 3. Rules shall be formulated by the Municipal Government for the following: 

(一)法律、法规规定由设区的市政府作出规定的事项;  

(i) Matters subject to the government’s rules of the city divided into districts under a national law and regulation; 

(二)市人民代表大会或其常务委员会授权市政府制定规章的事项; 

(ii) Matters which the Municipal People's Congress or its Standing Committee authorize the Municipal Government to formulate the rules; 

(三)为执行法律、行政法规、地方性法规和省政府规章的规定,需要制定规章的事项; 

(iii) Matters for which the enactment of a local rule is required in order to implement a national law, national administrative regulation, local regulation and/or Provincial regulation; 

(四)本市行政区域内具体行政管理的其他事项。 

(iv) Other matters concerning specific administration in light of the actual situation of the jurisdiction. 

第四条 下列事项,市政府可以拟定法规草案: 

Article 4. Draft regulations shall be provided by the Municipal Government for the following: 

(一)为执行法律、行政法规的规定,根据本市行政区域实际情况,需要作出具体规定的; 

(i) Matters for which enactment of a local decree is required in order to implement a national law or national administrative regulation in light of the actual situation of the jurisdiction; 

(二)属于地方性事务需要制定地方性法规的; 

(ii) Matters which are local in nature and require the enactment of a local decree. 

(三)除立法法第八条规定的事项外,国家尚未制定法律、行政法规,根据实际情况,需要制定地方性法规的。 

(iii) Except for matters enumerated in Article 8 of the Law on Legislation of the People's Republic of China, in respect of any other matter for which the state has not enacted national law or national administrative regulation, Handan People's Congress and/or its Standing Committee thereof may enact local decrees for the time being in light of its specific situations and actual needs. 

第五条 制定规章和拟定法规草案应当遵循以下原则: 

Article 5. The following principles have to be complied with when making rules and drafting regulations: 

(一)依法立法原则。遵守立法法确定的基本立法原则,符合宪法、法律、法规和其他上位法的规定。 

(i) The principle of law-based legislation. The basic legislative principles defined by the Legislative Law, the constitution, the law, regulations as well as other provisions of higher norms shall  be followed.  

(二)精简、统一、效能的原则。相同或相近的职能应当规定由一个行政机关承担,简化行政管理手续,促进政府职能向宏观调控、市场监管、社会管理、公共服务、环境保护等方面转变。 

(ii) The principle of simplification, unity and efficiency or efficacy. The same or similar functions shall be performed by one administrative organization, so as to simplify administrative procedures and promote the transformation of government functions into macro-control, market supervision, social management, public services and environmental protection. 

(三)职权与责任相统一原则。在赋予有关行政机关必要的职权的同时,应当规定其行使职权的条件、程序和应承担的责任。切实保障公民、法人和其他组织的合法权益,没有法律、行政法规、地方性法规的依据,规章不得设定减损公民、法人和其他组织权利或者增加其义务的规范。 

(iii) The principle of unity of authority and responsibility. While conferring the necessary powers to the relevant administrative organization, it shall stipulate the conditions, procedures and responsibilities for exercising the power. The lawful rights and interests of physical and moral persons and other organizations shall be protected and guaranteed effectively. Without the basis of national laws, national administrative regulations and/or local regulations (decree), the rules shall not set norms that derogate from the rights or increase obligations of citizens, legal persons and other organizations. 

(四)民主立法原则。通过有效的方式广泛听取各方面的意见,实行开门立法,充分体现人民的意志。 

(iv). The principle of democratic legislation. The government shall listen to and welcome the opinions of various parties in an effective way during legislation, so that the laws and regulations may fully reflect the will of the people. 

第六条 市政府立法机构是市政府制定规章和拟定法规草案工作的职能机构,负责下列工作: 

Article 6. The Legislative Affairs Office of the Municipal Government (hereinafter referred to as the Municipal Legislative Affairs Office) is the functional body to formulate rules and draft regulations. It takes the responsibility for the following tasks: 

(一)编制市政府制定规章和拟定法规草案的规划和年度计划,报市政府批准后组织实施; 

(i) To prepare a program for legislation and an annual plan of rules and draft regulations by the Municipal Government; and then to organize the implementation of them after the approval of the Municipal Government. 

(二)对规章和法规草案送审稿进行审查、协调和修改,向市政府报告审查意见; 

(ii) To review, coordinate and revise the submitted version of the draft rules and draft regulations, and to report the review opinions to the Municipal Government; 

(三)起草或主持起草某些重要规章草案或法规草案; 

(iii) To draft or preside over the drafting of some important rules or draft regulations; 

(四)组织召开有关规章草案和法规草案协调会、论证会和听证会; 

(iv) To organize and hold coordinated meetings, feasibility study meetings, hearing on related draft rules and draft regulations; 

(五)承办规章的公布、备案、解释工作; 

(v) To undertake the promulgation, filing and interpretation of the rules; 

(六) 负责规章汇编、标准文本的编辑发行工作和规章的外文译制组织工作; 

(vi) To be responsible for the work of compilation of rules,the issuance of standard version and translation of rules. 

(七)研究上位法立法动态、本市立法情况,清理本市规章; 

(vii) To study the legislation trends of higher norms, the legislative situation of the municipality and to clean up the rules; 

(八)制定规章和拟定法规草案的其他方面的工作。 

(viii) To work on other aspects of the preparation of rules and draft regulations. 

第七条 市政府各部门、各县级人民政府以及依法行使行政权的其他机构应当配合市政府立法机构做好如下工作: 

Article 7. All the departments of the Municipal Government, people's governments at the county level and other organizations exercising administrative power according to law shall support the Municipal Legislative Affairs Office to conduct the following work: 

(一)结合本单位实际,研究上位法律、行政法规、地方性法规、规章以及外地有关的立法动态,及时向市政府提出立法建议; 

(i) To study the national laws, national administrative regulations, local regulations and rules and other higher norms, as well as the legislative trends in other places according to the actual situation of the organization, and submit the legislative proposal to the Municipal Government within a reasonable time. ; 

(二)协助市政府立法机构召开立法协调会、论证会、听证会,并提供必要的条件; 

(ii) To assist the Municipal Legislative Affairs Office to hold the legislative coordinated meeting, feasibility study meeting, hearing, and to provide necessary conditions; 

(三)负责向市政府立法机构提供有关的立法项目的意见或建议; 

(iii) To be responsible for providing opinions or proposals on legislative items to Municipal Legislative Affairs Office; 

(四)其他有关制定规章和拟定法规草案的工作。 

(iv) Other works relating to the formulation of rules and the preparation of draft regulations. 

第八条 市财政部门应当按年度拨付立法经费,用于制定规章和拟定法规草案的起草、调研、论证、发布、翻译和汇编等项工作。 

Article 8. The Municipal Finance Department shall allocate legislative funds on an annual basis for the drafting, research, feasibility study, publication, translation and compilation of the rules and draft regulations. 

第九条 市政府立法机构应当于每年10月前启动下一年度立法工作计划项目征集工作。征集立法项目可以通过下列途径进行:   

Article 9. The Municipal Legislative Affairs Office shall start the solicitation of the next year’s legislative work plan before October each year. Solicitation of legislative items may be conducted by the following: 

(一)向市政府部门和县(市、区)人民政府征集立法建议项目; 

(i) Soliciting legislative proposals from Municipal Government departments and the people's governments at county level (municipality and district);  

(二)向人大代表、政协委员,以及民主党派、社会团体、行业协会、企业事业等单位征集立法建议项目; 

(ii) Soliciting legislative proposals from deputies to the people's congress, members of the Chinese People's Political Consultative Conference ( hereinafter referred to as the CPPCC), as well as institutions such as democratic parties, social organizations, trade associations, enterprises and so on; 

(三)向社会发布通告征集立法建议项目。 

(iii)  Issuing circulars to the public to solicit legislative proposals.. 

第十条 市政府各部门、各县级人民政府以及依法行使行政权的其他机构根据本单位工作情况,认为需要市政府制定规章或拟定法规草案的,应当制作立法建议书,于每年10月底之前送市政府立法机构。 

Article 10. Any department of the Municipal Government, people's governments at the county level or other institutions exercising administrative power, if they consider it necessary for the Municipal Government to formulate rules or draft regulations according to the actual situation, they shall prepare a legislative proposal, which shall be submitted to the Municipal Legislative Affairs Office before the end of October each year. 

立法建议书应当包括以下内容: 

The legislative proposal shall include the following contents: 

(一)规章、法规草案的名称; 

(i) The name of the rules and draft regulations. 

(二)制定该规章或法规草案的目的、宗旨以及必要性和可行性; 

(ii) The purpose, principle, necessity and feasibility of formulating the rules or draft regulations; 

(三)制定该规章或法规草案的法律依据,该规章或法规草案内容涉及的重大问题的初步调研论证情况; 

(iii) The legal basis for the formulation of the rules or draft regulations and the preliminary investigation and feasibility study of major issues involved in the rules or draft regulations. 

(四)该规章或法规草案的起草组织及进度安排; 

(iv) The drafting body and schedule of the rules or draft regulations. 

(五)建议该规章或法规草案发布施行的时间。 

(v) The recommended date for the issue and implementation of rules or draft regulations. 

第十一条 市政府立法机构对制定规章和拟定法规草案的建议进行汇总并作综合分析、评估论证后,编制市政府制定规章和拟定法规草案的年度计划草案报市政府常务会议审定。年度立法工作计划草案提交市政府常务会议审定前,应当按照规定向有关机关履行报告程序。 

Article 11. The Municipal Legislative Affairs Office shall, after summarizing, and making comprehensive analysis, evaluation and feasibility study of the proposals for the formulation of rules and draft regulations, prepare the annual legislative work plan draft for the formulation of rules and draft regulations and submit it to the executive meeting of the Municipal Government for review and approval. Before the draft of annual legislative work plan is submitted to the executive meeting of the Municipal Government for review and approval, it shall report to the relevant authorities in accordance with the relevant provisions. 

年度计划草案应当包括以下内容: 

The draft annual legislative work plan shall include the following: 

(一)规章或法规草案名称; 

(i) The name of the rules or draft regulations; 

(二)责任起草单位和协作单位; 

(ii) The responsible drafting body and cooperative organization; 

(三) 预计报送市政府审议的时间。 

(iii) The estimated date for submission to Municipal Government for review and approval. 

第十二条 规章、法规草案由市政府组织起草。 

Article 12. The rules and draft regulations shall be drafted by the Municipal Government. 

市政府可以确定一个部门或者几个部门具体承担起草工作,也可以确定由市政府立法机构起草或组织起草,起草专业性较强的规章,可以吸收相关领域的专家参与起草工作,或者委托有关专家、教学科研单位、社会组织起草。 

The Municipal Government may assign one or several departments to be responsible for the drafting, or assign the Municipal Legislative Affairs Office to draft or organize the drafting. If the draft rules are highly professional, the experts in related fields shall be invited into the drafting work, or the relevant experts, education & research institutions and social organizations can be entrusted to draft. 

第十三条 承担起草任务的单位、专家和组织应当认真负责,按计划要求完成起草任务。不能按计划要求完成起草任务的,应当写出书面报告,说明原因,由市政府立法机构审查并提出处理意见,报市政府决定。 

Article 13. The agencies, experts and organizations undertaking the drafting shall be serious and responsible, and complete the drafting as scheduled. When the drafting task cannot be completed as planned, a written report explaining the reasons is required, which shall be reviewed by the Municipal Legislative Affairs Office and submitted to the Municipal Government for approval. 

市政府立法机构应当对市政府制定规章和拟定法规草案年度计划项目的起草情况进行检查、督促、协调和指导。年度计划执行中需要进行个别调整的,由市政府立法机构报请市政府确定,拟增加的规章项目应当进行补充论证。 

The Municipal Legislative Affairs Office shall inspect, supervise, coordinate and guide the drafting of the Municipal Government's rules and the annual legislative work plans of the draft regulations. If individual adjustments are needed in the implementation of the annual legislative work plan, the Municipal Legislative Affairs Office shall report to the Municipal Government for confirmation and approval. The proposed supplementary regulations and items shall be further described and demonstrated.  

第十四条  起草规章和法规,除依法需要保密的外,起草单位报请市政府同意,将规章草案或法规送审稿及其说明等,向社会公布,公开征求意见,征求意见的期限一般不少于30日。 

Article 14. For the draft of rules and regulations, except those that need to be kept confidential according to law, the drafting body shall ask for Municipal Government’s approval on publishing the submitted version of the draft rules and the draft regulations, together with their commentaries to the public for consultation. The time duration for soliciting opinions shall generally not be less than 30 days. 

第十五条 起草的规章或法规涉及重大利益调整或者存在重大意见分歧,对公民、法人或者其他组织的权利义务有较大影响,人民群众普遍关注,需要进行听证的,起草单位应当经市政府批准同意后举行听证会听取意见。听证会依照下列程序组织: 

Article 15. When the draft rules and/or regulations involve major interest adjustments, or have major differences of opinions, or have a great impact on the rights & obligations of citizens, legal persons and/or other organizations to obtain great attention from people, and the hearing becomes necessary, the drafting body shall hold a hearing to solicit for opinions after approval by the Municipal Government. The hearing shall be organized in accordance with the following procedures:  

(一)听证会公开举行,起草单位应当在举行听证会的30日前通过市政府网站,或者部门网站及其他新闻媒体公布听证会的时间、地点和内容,以及申请作为听证陈述人的条件、申请的方式和截止时间等; 

(i) The hearing shall be held in public. The drafting body shall announce the time, place, content of the hearing through the website of the Municipal Government or the department website and other news media 30 days before the hearing, conditions for, the method and deadline of applying as a hearing representor, etc. 

(二)起草单位应当根据代表广泛性、利益相关性等原则,从申请人中选定10至20名陈述人,必要时,可以直接指定利益相关方代表、有利害关系的部门和个人或者邀请有关人大代表、政协委员及民主党派、无党派人士和专家、学者作为陈述人;  

(ii) The drafting body shall select 10 to 20 presenters from the applicants based on the principles of universality of representation, interest relevance etc. Where necessary, representatives of parties, departments and individuals with interests may be directly designated, and representatives of the people's congresses, members of the CPPCC committees and representatives of democratic parties, personages without party affiliation and experts as well as scholars may be invited as representors. 

(三)起草单位应当确定一名听证主持人,确定不少于2名听证人,听证人由承办人及熟悉征求意见稿的人员担任,负责在听证会上对听证事项进行说明、解释; 

(iii) The drafting body shall designate one hearing moderator/presider and not less than two hearing attendees (participants) to attend the public hearing. The attendees shall be the undertakers who are familiar with the exposure draft, and the attendees are responsible for the commentaries and explanation of issues discussed in the public hearing. 

(四)参加听证会的有关机关、组织和公民对起草的规章,有权提问和发表意见; 

(iv) The relevant authorities, physical or moral or representatives of any other recognized organization participating in the hearings shall have the right to ask questions and express their opinions on the draft rules;  

(五)听证会应当制作笔录,如实记录发言人的主要观点和理由; 

(v) A written record shall be prepared for the hearing to truthfully record the speaker's major views and reasons; 

(六)起草单位应当认真研究听证会反映的各种意见,起草的规章在报送审查时,应当说明对听证会意见的处理情况及其理由。 

(vi) The drafting body shall carefully study the various opinions in the hearing. The draft rules, upon submission for review, shall state the handling of proposals at the hearing and the corresponding reasons.  

(七)听证会结束后5个工作日内拟定听证报告,详细汇总各方面的意见。 

(vii)  The report of the hearing shall contain a detailed summary of the opinions of all the parties present at the hearing. The g report shall be finished within 5 working days after the hearing.  

第十六条 起草工作完成后,起草单位主要负责人应签署意见并加盖单位印章,将送审稿报送市政府立法机构进行审查。 

Article 16.  Upon completion of the draft rules and the draft regulations, the top leadership of the drafting body (key person chiefly held responsible) shall write comments and sign his/her name, then affix the seal of the organization, and submit it to the Municipal Legislative Affairs office for review.  

起草单位报送规章和法规草案送审稿时,应当同时提交起草说明和所依据的有关资料。起草说明应包括起草的经过、制定规章或法规的必要性、规章或法规草案主要措施、有关方面的意见及其协调处理情况等内容。有关资料主要包括所规范领域的实际情况和相关数据、实践中存在的主要问题、汇总的意见、听证会笔录、调研报告、市内外有关立法资料等。 

The drafting body shall simultaneously submit for review the draft rules and regulations, commentaries and any relevant materials on which the draft is based.  ,  . The drafting explanations shall include the process of drafting, the necessity of formulating rules or regulations, the main measures included, the opinions of the parties concerned and handling of their opinions. The relevant materials mainly include the actual situation and relevant data in the normative field, the main problems or issues in practice, the summary of opinions, the written record of the hearing, the investigation report, and the relevant legislative materials within and outside Handan city. 

第十七条 市政府立法机构应当从以下几个方面对规章和法规草案送审稿进行审查: 

Article 17. The Municipal Legislative Affairs Office shall review the submitted version of the draft rules and the draft regulations with respect to the following aspects:  

(一)是否符合本规定第五条的要求; 

(i) Whether it meets the requirements of article 5 of these Provisions; 

(二)是否与现行的本市法规和规章相协调、相衔接; 

(ii) Whether it is coordinated and connected with the current municipal laws and regulations; 

(三)涉及的行政许可、行政处罚、行政强制措施和其他行政措施是否合法且确有必要; 

(iii) Whether the administrative licensing, administrative penalty, administrative coercive measures and other administrative measures involved are lawful and necessary; 

(四)是否有利于促进公平竞争和经济社会发展; 

(iv) Whether it is conducive to promote fair competition and socioeconomic development; 

(五)是否进行社会稳定风险评估; 

(v) Whether to carry out risk assessment of social safety and stability; 

(六)对各方面的意见处理是否合法、合理; 

(vi) Whether the handling of opinions of all parties is legal and reasonable;  

(七)是否符合立法技术要求; 

(vii) Whether it meets the requirements of the legislative techniques; 

(八)需要审查的其他内容。 

(viii) Whether there is any other content to be reviewed. 

第十八条 市政府立法机构审查、修改规章和法规草案送审稿,应当进行调查研究,广泛征求有关行政主管机关、管理相对人和社会各方面的意见,并对拟定的重大方针政策及其他争议较大的问题进行论证,必要时可组织有关方面专家进行论证。 

Article 18. When the Municipal Legislative Affairs Office review and revise the submitted version of the draft rules and the draft regulations, it shall conduct investigations and research in detail, solicit opinions from relevant administrative competent authorities, administrative authorities concerned and from management relative person and all sectors in society. Moreover, it shall make feasibility study on controversial issues, for instance, major policies included. Where need arises, the relevant experts shall be invited for feasibility study. 

第十九条  规章送审稿有下列情形之一的,市政府立法机构可以中止审查、缓办或退回起草单位,并要求起草单位重新起草或者提出合理的解决方案: 

Article 19.  If the submitted version of the draft rules for review under any of the following circumstances, the Municipal Legislative Affairs Office may suspend or postpone the review, or return it to the drafting body, and request the drafting body to re-draft or propose reasonable solutions: 

(一)制定规章的基本条件尚不成熟或者发生重大变化的; 

(i) Where the basic conditions for the formulation of rules are still immature or major changes have taken place; 

(二)有关机构或者部门对规章送审稿规定的主要制度存在较大争议,起草单位未与有关机构或者部门充分协商的; 

(ii) Where the relevant institutions or departments have a big dispute over the main system stipulated in the provisions of submitted version of the draft rules, but the drafting body has not fully consulted the relevant institutions or departments; 

(三)未按照本规定有关规定公开征求意见的; 

(iii) Failure to solicit public opinions in accordance with the relevant rules hereof; 

(四)送审稿主要内容严重违法的。 

(iv). Where the main content of the submitted version of the draft rules is seriously illegal or contrary to the laws in force 

中止审查、缓办或退回原起草单位应附书面意见,说明存在的主要问题。原起草单位应当进行修改或按本规定要求重新组织起草,并及时报送市政府立法机构。 

Any suspension of review, postponement or return to the drafting body during the process shall be accompanied by a written opinion indicating the main problems. The original drafting body shall revise or reorganize the drafting according to the requirements of these Provisions and submit the draft to the Municipal Legislative Affairs Office within a reasonable time limit. 

第二十条 送审稿内容涉及其他行政机关或单位权益的,市政府立法机构应当将送审稿全文发送到该机关或单位征求意见。被征求意见的机关或单位应当在规定的期限内书面反馈意见。书面意见上应加盖本单位印章,应有主要负责人签字。 

Article 20. If the content of the submitted version of the draft rules involves the rights & interests of other administrative organizations or agencies, the Municipal Legislative Affairs Office shall send the full version of the draft to such organizations or agencies for comments and review. The consulted organizations or agencies shall give written feedback within the stipulated time limit. The written proposals shall be affixed with the seal of the organization and signed by the president.   

有关机关或单位不能在规定的期限内反馈意见的,应当说明原因。未在规定的期限内反馈意见,又不说明原因的,视为同意。 

The consulted organizations or agencies shall give feedback within the prescribed time limit, except tangible reasons are made. If the feedback is not given within the prescribed time limit and the reasons are not given, it will be taken that they have agreed to the case being specified under the rules. 

第二十一条 规章和法规草案内容对全市发展有重大影响,或者涉及公民、法人和其他组织的重大权益的,经市政府同意,市政府立法机构应在市政府审议前将草案全文在《邯郸日报》、市政府门户网站或市政府立法机构网站上全文公布,公开征求社会各界的意见。公布征求意见的期限一般不少于30日。 

Article 21. The Municipal Legislative Affairs Office shall publish the full version of the draft for soliciting the opinions of the public on the Handan Daily, the website of Municipal Government and/or the website of the Municipal Legislative Affairs Office before the deliberation of the Municipal Government when the drafted rules and/or regulations have significant impact on the development of the whole Municipality, or involve the important rights & interests of citizens, legal persons and other organizations, upon the approval of the Municipal Government. The time limit for public consultation shall not be less than 30 days. 

任何单位和个人均有权对规章和法规草案的内容提出意见。 

Any organization or individual shall have the right to advice on the contents of these rules and draft regulations. 

市政府立法机构应当对各种意见进行认真的整理和研究,在审查和修改时作为参考。 

The Municipal Legislative Affairs Office shall carefully collate and study various opinions for reference during the review and revision. 

第二十二条 有关部门和单位对规章和法规草案内容有不同意见的,市政府立法机构应当进行协调,力求达成一致意见。对有较大争议的重要立法事项,市政府立法机构可以委托有关专家、教学科研单位、社会组织进行评估。经协调仍不能达成一致意见的,应当将主要问题、有关机构或者部门的意见和立法机构的意见及时报市政府协调,或者报市政府决定。 

Article 22. If relevant departments and authorities have a major difference of opinion on the content of the rules and draft regulations, the Municipal Legislative Affairs Office shall coordinate and strive to reach a consensus. If there is a major difference of opinions on major issues, the Municipal Legislative Affairs Office may entrust to relevant experts, education & research institutions and social organizations to evaluate significant legislative matters in dispute. If no consensus can be reached after coordination and consultation, the major issues, opinions of relevant agencies, departments and the Municipal Legislative Affairs Office shall be reported to the Municipal Government for timely coordination or further decision. 

第二十三条  规章或法规送审稿涉及重大利益调整的,市政府立法机构应当进行论证咨询,广泛听取有关方面的意见。论证咨询可以采取座谈会、论证会、听证会、委托研究等多种形式。 

Article 23. When the submitted version of the draft rules and draft regulations involves major adjustments of interests, the Municipal Legislative Affairs Office shall conduct the feasibility study and consultation, and listen to the opinions of relevant parties extensively. Demonstration and consultation may take place in various forms, such as symposium, feasibility study meeting, hearing, and commissioned research. 

规章或法规送审稿涉及重大利益调整或者存在重大意见分歧,对公民、法人或者其他组织的权利义务有较大影响,人民群众普遍关注,起草单位在起草过程中未举行听证会的,市政府立法机构经市政府批准,可以举行听证会。举行听证会的,应当依照本规定第十五条规定的程序组织。 

The Municipal Legislative Affairs Office may hold a hearing upon the approval of the Municipal Government when the drafting body fails to hold a hearing during the drafting process when the submitted version of the draft rules and draft regulations involve major adjustment of interests or major disputes, have a significant impact on rights & interests of physical and corporate persons and other organizations, and obtain great attention from the people. When a hearing is held, the hearing shall be organized in accordance with the procedures stipulated in article 15 hereof. 

第二十四条  重要的政府规章和地方性法规项目,应当进行立法协商。涉及职工、妇女儿童、残疾人等不同社会群体利益的,应当征求市总工会、市妇联、市残联等社会团体的意见,充分发挥政协委员、民主党派、工商联、无党派人士、人民团体、社会组织的作用。 

Article 24. The major and significant government rules and local regulations shall be subject to legislative consultation. If the interests of different social groups, such as workers, women and children, and disabled persons are involved, it shall be consulted by social federations like the municipal federation of trade unions, the municipal women's federation, and the municipal federation of disabled persons. We shall give full play to the role of CPPCC members, democratic parties, federation of industry and commerce, personages without party affiliation, people's organizations and social organizations. 

立法协商可以采用书面征求意见、座谈会、委托论证、联合调研等方式进行。 

The legislative consultation may be conducted by means of soliciting opinions in writing, seminars, feasibility study-commissioned and joint research. 

第二十五条 市政府立法机构对规章和法规草案送审稿审查、修改后,形成规章草案或法规草案送审稿,拟制审查报告(直接起草或组织起草的,拟制起草说明)一并报送市政府。 

Article 25. After reviewing and revising the submitted version of the draft rules and the draft regulations, the Municipal Legislative Affairs Office shall provide a new submitted version of the draft rules and the draft regulations, and prepare the review report (if the drafting of rules and/or draft regulations are prepared by the office directly or by its collaboration, drafting commentaries are required), which shall be submitted to the Municipal Government.  

审查报告应当包括以下内容: 

The review report shall include the following content; 

(一)制定规章或拟定法规草案的目的和必要性; 

(i) The purpose and necessity of formulating rules and draft regulations; 

(二)制定规章或拟定法规草案的主要依据; 

(ii) The main basis of formulating rules and draft regulations; 

(三)规章草案或法规草案送审稿的主要内容; 

(iii) The major content of the submitted draft rules and/or the submitted draft regulations; 

(四)专家论证意见、听证会情况及其他征求意见的情况; 

(iv) The expert’s opinions on feasibility study, hearing information and other information of consultations; 

(五)协调情况; 

(v) Information of coordination;  

(六)其他需要说明的问题。 

(vi) Other issues to be explained.  

第二十六条 规章草案或法规草案送审稿由市政府常务会议或全体会议讨论决定。市政府办公厅应当提前将规章草案或法规草案送审稿及审查报告报送市长及市政府其他各位领导。规章草案需要向有关机关报告的,应当在审议前按照规定履行报告程序。 

Article 26. The submitted version of the draft rules and the draft regulations for review shall be discussed and determined by the executive meeting or plenary meeting of the Municipal Government. The General Office of the Municipal Government shall submit the submitted version of the draft rules and/or the regulations for review, together with its review report, to the mayor and other leaders of the Municipal Government in advance. Where it is necessary to report the draft rules to the relevant authorities, the reporting procedures shall be performed in accordance with the provisions before the meeting for deliberation.  

第二十七条 市政府常务会议或全体会议审议规章草案或法规草案送审稿时,由市政府立法机构作审查报告,由起草单位和市政府立法机构负责答复有关询问。 

Article 27. Upon the examination of the submitted version of the draft rules and/or draft regulations at the executive meetings or plenary meetings of the Municipal Government, the Municipal Legislative Affairs Office shall prepare the review report, and the drafting body and the Municipal Legislative Affairs Office take the responsibility for replying to the relevant inquiries. 

第二十八条 市政府常务会议或全体会议对规章草案或法规草案送审稿审议后,由市长或其委托主持会议的副市长决定是否通过。 

Article 28. After being examined and deliberated upon by the executive meetings or plenary meetings of the Municipal Government, the mayor or the entrusted deputy mayor shall weigh the arguments and decide whether a settlement of the submitted version of the draft rules and/or the draft regulations can go forward. 

对原则通过,需要根据会议讨论意见进行修改的规章草案或法规草案送审稿,由市政府立法机构负责组织修改。 

If the submitted version of the rules and/or the draft regulations are reviewed and approved in principle and in need of further revision based on the opinions given at the meeting, the Municipal Legislative Affairs Office shall be responsible for the revision of the rules and/or the submitted draft regulations.  

第二十九条 规章草案经市政府常务会议或全体会议审议通过后,由市长签署市政府令予以公布。 

Article 29. After the draft rules have been deliberated upon and approved by the executive meeting or plenary meeting of the Municipal Government, the mayor shall sign a decree of the Municipal Government and make it known to the public. 

法规草案送审稿经市政府常务会议或全体会议审议通过后,由市长签署市政府议案提请市人民代表大会或其常务委员会审议。 

After the submitted version of the draft regulations have been deliberated and approved by the executive meeting or plenary meeting of the Municipal Government, the mayor shall sign a bill of the Municipal Government and submit to the municipal people's congress or its standing committee for deliberation. 

第三十条 规章公布后,《邯郸市人民政府公报》和《邯郸日报》应当及时全文登载,《邯郸晚报》、邯郸广播电视台应及时发布消息。重要的规章,《邯郸日报》、邯郸广播电视台相关栏目应当配合刊发有关评论和文章;必要时,市政府立法机构可以组织召开新闻发布会或在《邯郸日报》、邯郸广播电视台相关栏目上就有关问题进行解答。 

Article 30. After the publication of the rules, Handan People's Government Bulletin and Handan Daily shall print the rules in full within a reasonable time frame; Handan Evening Newspaper and Handan Radio & Television Station shall release information timely. If the rules are important, Handan Daily and Handan Radio & Television Station shall publish the related commentary and articles in relevant columns. If necessary, the Municipal Legislative Affairs Office can organize a press conference, answer questions directly on relevant columns of Handan Daily and Handan Radio & Television Station. 

刊发或播发规章有关消息、文章,新闻单位不得收取费用。召开新闻发布会按照有关规定执行。 

The news press shall not be charge for the publishing and/or broadcasting of the rules information. The press conference shall be held in accordance with relevant provisions. 

《邯郸市人民政府公报》上刊登的规章文本为标准文本。 

The version of the rules printed on the Bulletin of the Handan People's Government shall be the standard version.  

第三十一条  规章公布后,由市政府立法机构按照《法规规章备案条例》的规定,向国务院、省人大常委会、省政府、市人大常委会备案。 

Article 31. After the promulgation of the rules, the Municipal Legislative Affairs Office shall, in accordance with provisions stipulated on the Ordinance on the Archivist Filing of Regulations and Rules, submit to the State Council, the Standing Committee of Hebei Provincial People's Congress, Hebei Provincial Government and the Standing Committee of Handan Municipal People's Congress for filing. 

规章公布后,市政府立法机构应当在三个月内,组织规章英文翻译,并将中英文对照版在市政府门户网站、市政府立法机构门户网站公布。 

After the promulgation of the regulations, the Municipal Legislative Affairs Office shall organize and ensure the English translation of the regulations and publish the bilingual version on the portal website of the Municipal Government and the portal website of the Municipal Legislative Affairs Office within three (3) months’ time interval.  

第三十二条  国家机关、社会团体、企业事业组织、公民认为市政府规章同法律、行政法规相抵触或者违反其他上位法的规定的,可以向国务院、省政府或市政府书面提出审查建议。 

Article 32. Where any state organ or social group, enterprise or non-enterprise institution or citizen, deems that the rules contravene a national law and or a national administrative regulation, or in violation of the provisions of other higher norms, it may make a written proposal to the State Council, Hebei Provincial Government or Handan Municipal Government for review. 

向市政府提出的书面审查建议,可以直接送市政府立法机构,市政府立法机构应当组织审查论证,并在60日内向建议提出人书面反馈。 

The written proposal for further examination submitted to the Municipal Government may be directly sent to the Municipal Legislative Affairs Office. The Municipal Legislative Affairs Office shall organize the review and feasibility study on it, and give written feedback to the person that submitted the proposal within 60 days.  

第三十三条  有下列情形之一的,市政府立法机构应当组织进行规章清理:  

Article 33. In any of the following circumstances, the Municipal Legislative Affairs Office shall organize the clean-up of rules: 

(一)上级机关或者法律、行政法规规定要求清理的; 

(i) Where the authority at higher level, national law and/or motional administrative regulation requires cleaning up; 

(二)上位法发生制定、修改或者废止等情形涉及多件规章,需要进行清理的; 

(ii) Where the formulation, amendment or abolition of higher norms involves a number of rules that need to be cleaned up; 

(三)根据经济社会发展要求,有较多规章存在明显不适应情形,需要进行清理的; 

(iii) Where there are many rules that obviously do not adapt to the situation and need to be cleaned up in accordance with the requirements of economic and social development;  

(四)其他原因需要进行清理的。 

 (iv) Where the rules need to be cleaned up for other reasons. 

第三十四条  市政府授权市政府立法机构组织立法后评估,并把评估结果作为修改、废止有关规章的重要参考。 

Article 34. The Municipal Government shall authorize the Municipal Legislative Affairs Office to organize the post-legislation evaluation, and shall take the evaluation results as an important reference for revising and abolishing relevant regulations. 

规章有下列情形之一的,市政府立法机构应当组织开展立法后评估: 

In the case of any of the following situations, the Municipal Legislative Affairs Office shall organize the post-legislative evaluation for the regulations:  

(一)施行满3年的; 

(i) Where it is three years since regulations implementation  

(二)拟以规章为基础提出地方性法规案的; 

(ii) Where the draft regulations are proposed on the basis of the rules. 

(三)需要进行全面修订或者较大幅度修改的; 

(iii) Where it is necessary to make a comprehensive or substantial revision  

(四)公民、法人和其他组织有较多意见的; 

(iv) Where physical and moral persons and other organizations have great dispute over the regulations.  

(五)市政府立法机构认为需要评估的。 

(v) Where the Municipal Legislative Affairs Office deems regulations necessary to be assessed. 

规章立法后评估可以委托有关专家、高等院校、科研机构、专业智库、律师事务所等实施,也可以由市政府立法机构、实施机关组织实施。 

The post-legislative evaluation of regulations may be conducted by entrusting to relevant experts, universities, scientific research institutions, professional think tanks, law firms, etc., or be organized and implemented by the Municipal Legislative Affairs Office and the implementing organizations . 

第三十五条 违反本规定,有下列行为之一的,由市政府立法机构责令限期改正,拒不改正的,给予通报批评。对行政管理造成严重影响的,有关部门应当依法追究责任单位领导人和直接责任人的行政责任。 

Article 35. In any of the following circumstances in violation of these provisions, the Municipal Legislative Affairs Office shall order the violator to correct within a specified time limit. Those who refuse to correct the situation shall be criticized in a circular. In the case of serious impact on administrative management, the departments concerned shall investigate and affix the administrative responsibility of the leader of the organization and the person directly responsible according to law. 

(一)起草单位不说明理由,未按计划完成起草任务,致使立法计划受到严重影响的; 

(i) Where the drafting body fails to complete the drafting task as planned without clarifying reasons, thus seriously affecting the legislative plan; 

(二)无正当理由逾期不反馈意见的; 

(ii) Where the organization fails to give feedback within the time limit without justified reasons; 

(三)不按要求参加有关立法会议的; 

(iii) Where the organization does not attend the relevant legislative meetings as required 

(四)其他违反本规定的行为,致使立法工作受到严重影响的。 

(iv) Where the organization violates other articles of these provisions, which seriously affect the legislative work. 

第三十六条 规章汇编由市政府立法机构组织编印出版,外文译本由市政府立法机构组织翻译并审定。 

Article 36. The compilation of regulations shall be conducted and published by the Municipal Legislative Affairs Office. The foreign translation shall be conducted and approved by the Municipal Legislative Affairs Office. 

市政府立法机构组织编印的规章汇编和外文译本可以在汇编封面上加印国徽,作为执法、守法的依据。 

The Municipal Legislative Affairs Office may print the national emblem on the cover of the compilation of regulations together with their foreign translation, which can be used as the evidence for law enforcement and compliance. 

第三十七条  规章明确规定有关单位对专门事项制定配套的具体规定的,有关单位应当自施行之日起三个月内作出规定。规章对配套具体规定制定明确特定期限的,从其规定。 

Article 37. Where the relevant regulations clearly stipulate that the relevant organizations shall formulate detailed ancillary provisions for special matters, the relevant organizations shall make provisions within three (3) months from the date of implementation. Where the regulations specify a specific time limit for detailed ancillary provisions, the provisions shall apply. 

有关单位未能在期限内制定配套的具体规定的,应当书面向市政府报告。 

If the relevant organization fails to formulate specific detailed ancillary regulations within the time limit, they shall report to the Municipal Government in written form within a reasonable time frame.  

第三十八条  本办法第三条、第四条所涉事项,仅限于城乡建设与管理、环境保护、历史文化保护等方面的事项。 

Article 38. “The matters covered by articles 3 and 4 of these Provisions are limited to the matters relating to the urban and rural development and administration, the environmental protection and the historical culture protection. 

第三十九条 修改规章和对本市现行法规提出修正案,按本规定执行。 

Article 39. To amend the regulations and propose amendments to the current laws and regulations of the municipality, these provisions shall be applicable.  

第四十条  本规定自2003年5月15日起施行。 

Article 40 These Provisions shall come into full force on May 15, 2003.
